ORDINANCE NO. 1987-447

AN ORDINANCE OF THE BOROUGH OF MARTINSBURG, PENNSYLVANIA,

PROHIBITING THE USE OF SKATEBOARDS ON THE BOROUGH SIDEWALKS AND STREETS

BE IT ORDAINED AND ENACTED and it is hereby ordained and enacted by the council of the Borough of Martinsburg, Pennsylvania:

Section 1: It shall be unlawful for any person to ride on a skateboard or similar type skating mechanism upon any sidewalk in the borough or upon any roadway in the borough.

Section 2: It shall be unlawful for any person to engage in skateboarding, on any street, sidewalk or roadway or any other public place or on private property located in the Borough, unless on such private property the skateboarder has the express consent of the owner thereof, except nothing in this paragraph shall prevent a pedestrian from pulling a coaster or other toy vehicle with or without a rider upon a sidewalk.

Section 3: Any person who violates any provision of this Section shall, upon conviction be sentenced to pay a fine of not less that $25 and not more than $300, plus costs.

This Ordinance shall become effective September 3, 1987.

ORDAINED AND ENACTED BY THE Council of the Borough of Martinsburg the third day of August, 1987.
