ORDINANCE NO. 2006-559

AMENDMENT TO ORDINANCE NO. 496 OF THE BOROUGH OF MARTINSBURG, BLAIR COUNTY, PENNSYLVANIA, ESTABLISHING VARIOUS PARKING REGULATIONS

  1. Penalty. Any person or persons, firm or corporation found in violation of this Ordinance shall be guilty of a summary offense and made to pay a fine of not less than $15.00, nor more than $300.00 for the use of said Borough of Martinsburg, plus any towing and storage fees along with court costs and costs of prosecution and/or shall be incarcerated within the Blair County Prison for a period of time not to exceed ninety (90) days and/or both.

    The procedure for a police officer of the Borough of Martinsburg would be to attach a parking ticket to the vehicle in violation for the amount of $15.00. The violator would pay directly to the $15.00 ticket to the Borough of Martinsburg. If the violator would fail to pay the $15.00 ticket within forty-eight (48) hours, a citation either under this Ordinance or the Pa. Motor Vehicle Code would be filed at the Office of the Issuing Authority, who would set the fine and/or imprisonment as the penalty, which has already been so stated above, which is a sliding within this Ordinance or within the Pa. Motor Vehicle Code.

    Exception would be for violators of the Handicapped Parking which the fine is placed at $50.00 if a parking ticket is attached to the vehicle that is in violation.  Otherwise, all other penalties regarding the sliding find and/or imprisonment are the same as above when filed at the Office of the Issuing Authority.

    A police officer of the Martinsburg Police Department has the discretion and the authority to choose on the issuing of a parking ticket, the filing of a parking violation under this Ordinance at the Office of the Issuing Authority or to file a citation under the Pa. Motor Vehicle Law at the Office of the Issuing Authority.

  2. All other provisions of Ordinance No. 496 remain in full force and effect.

    ORDAINED AND ENACTED this 6th day of February, 2006, by the Borough of

    Martinsburg.
